In order to exercise the right to the protection of personal data with regard to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation) in this document we explain when and why we collect and process personal data.

3. Purpose and legal basis for processing personal data
3.1. We process your personal data based on consent in the sense of Article 6, paragraph 1, point (a) of the General Regulation, for the purpose of:
- providing answers to received inquiries;
- current and future communications related to sales;
- to help develop and improve products and services tailored to you;
- for the purpose of better functioning of all website features and enabling a better user experience (see more in the Cookie Policy);
- marketing activities;
- reimbursement of the cost of caring for a minor child of an employee of Proton EE-Elektronika d.o.o.
3.2. We process your personal data in fulfilment of our legal obligations in the sense of Article 6, paragraph 1, point (c) of the General Regulation for the purpose of:
- fulfilling the obligations of the contract concluded with you;
- solving problems/complaints during the duration of the contract and/or service provision/product delivery;
- responding to a request to exercise the right to access information;
- employment in our company.
3.3. We process your personal data on the basis of legitimate interest in the sense of Article 6, paragraph 1, point (f) of the General Regulation, for the purpose of:

6.1. The right to be informed about the processing of your personal data
6.2. The right to access your personal data
You have the right to access your personal data we are processing and you may request detailed information, in particular, on purpose of processing, on the type/categories of personal data that are being processed, including access to your personal data, information on recipients or categories of recipients, and on the data retention period.
Access to personal data may be limited only in cases prescribed by Union law or by our national legislation, or where such limitation respects the fundamental rights and freedoms of others.
6.3. The right to rectification of your personal data
You have the right to request the rectification of personal data if your data are incorrect, incomplete and up to date.
Please note that in the request it is necessary to specify what is not accurate, complete or up-to-date and in what sense the above should be corrected and submit the necessary documentation in support of your allegations.
6.4. The right to the erasure of your personal data
You have the right to request the erasure of your personal data if one of the following conditions is fulfilled:
- Your personal data are no longer necessary to fulfil the purpose for which we collected or processed them;
- You have withdrawn the consent on which the processing is based in accordance with point (a) of Article 6(1) or point (a) of Article 9(2) and there is no other legal basis for processing;
- You have objected to the processing of your personal data in accordance with Article 21(1) of the General Data Protection Regulation and if there are no legitimate reasons for processing;
- Your personal data have been illegally processed;
- Your personal data must be erased in order to comply with a legal obligation under Union or State law to which the controller is subjected
- Your personal data have been collected in relation to the provision of information society services referred to in Article 8(1).
6.4.1. Exceptions related to the exercise of the right are provided for in Article 17, Paragraph 3 of the General Regulation
The rights are not applicable to the extent that processing is necessary:
- in order to exercise the right to freedom of expression and information;
- to comply with a legal obligation requiring processing under Union law or the law of a Member State to which the Data Controller is subject, or for the performance of a task in the public interest or in the exercise of official authority of the Data Controller;
- for the purposes of archiving in the public interest, for the purposes of scientific or historical research or for statistical purposes in accordance with Article 89, paragraph 1, to the extent that it is likely that the right from paragraph 1 can prevent or seriously threaten the achievement of the goals of that processing; or
- in order to establish, realize or defend legal claims.
6.5. Right to restrict the processing of personal data
You have the right to obtain a restriction on processing if:
- You dispute its accuracy;
- If the processing is unlawful and you oppose to its erasure;
- If the Data Controller no longer needs personal data but you requested to process your data for the purpose of setting, fulfilling or defending legal claims;
- If you have objected to the processing of your personal data.
6.6. The right to object to processing of your personal data
You have the right to object at any time to processing of personal data concerning him or her which is based on the legitimate interest.
6.7. The right to data portability
You have the right to receive your personal data which you have provided to us, in a structured, commonly used, and machine-readable format.
According to Art. 20 of the General Regulations on Data Protection, the data subject’s right to transfer data from one Data Controller to another, or service provider, is related to cases of personal data processing based on consent or contract. An additional condition that must be met is that it is about automatic data processing. Both conditions must be met for the respondent to have the right to portability of personal data.
6.8. Rights relating to automated decision making and profiling
The regulation allows respondents to have the right to refuse to submit to automated individual decision-making or profiling, which stems from the principle of transparency and the need for respondents to be able to manage their personal data to the greatest extent possible.
6.9. The right to withdraw consent at any time.
7. Use of personal data
Your personal data may be available to the provider of IT and communication solutions to the extent necessary to provide the service. These Data Processors have singed Data Protection Agreement (DPA) and therefore they are not able to process your personal data without our order and pass them on to third parties.
We may share your personal data with service providers, business partners and other third parties, in accordance with applicable law and business contracts we have with such institutions. In certain cases, when the law does not prescribe it, your personal data may be forwarded to third parties such as: an accounting service, a company that provides a software service for customer records, a company that analyses wishes and interests on our website, a delivery service, and the like. Hereby the company Proton EE-Elektronika d.o.o. confirms that it has warned all suppliers with which it cooperates that they themselves are obliged to comply with the GDPR. All personal data that are not part of legal obligations must be resolved by concluding an agreement on the transfer and processing of personal data (the so-called DPA agreement) in which the supplier’s obligations to treat the personal data obtained in this relationship in accordance with the law and other positive regulations and to apply adequate organizational and technical data protection measures are clearly prescribed.
If we are required by law to obtain your consent or for some other reason, we will ask for your consent before sharing your personal information.
Your personal data will not be passed on to third parties for direct marketing purposes.

9. Children and minors
Proton EE-Elektronika d.o.o. does not communicate in any sense with children and/or minors. If contact happens by chance, every contact and communication with children and minors is carried out in such a way as to communicate, talk, negotiate and contract exclusively with the parent/guardian. The contract, agreement, consent, and any other legally binding document is signed exclusively by the parent/guardian.
10. Security of personal data
We collect and process personal data in a way that ensures adequate security and confidentiality in their processing and enables effective application of data protection principles, reduction of the amount of data, scope of their processing, storage period and their availability.
We take all appropriate technical and organizational security measures to prevent accidental or illegal destruction, loss, modification, unauthorized use, disclosure, insight, or access to data.
All employees of the Data Controller undertake to keep personal data by signing a confidentiality statement.
Director and employees of Proton EE-Elektronika d.o.o. they are obliged to keep all personal and other confidential information that they learn in the performance of their duties as a professional secret. The stated obligation continues even after termination of employment at Proton EE-Elektronika d.o.o.
11. Data retention period
We process your personal data until the purpose of personal data processing is fulfilled. After the end of the purpose for which they were collected, we no longer use your personal data. Data remain in our storage system as long as we are obliged by the legal regulations on the preservation of archival material.
